Mountain Creek Labradoodles Health Guarantee

This contract is between Mountain Creek Labradoodles, LLC (Seller) and: _______________ (Buyer)Buyer agrees to pay the sum of $2650 before the transfer of possession, which is the companion pet price for the dog. This fee includes the initial deposit paid, the balance of the puppy purchase price, but does not include shipping fees or training fees, if applicable.

CONDITIONS OF SALE

Seller guarantees that at the time of delivery the dog is in good health, as far as appears to the eye, has received appropriate medical inoculations, worming, and care. All medical records for dog have been provided to Buyer along with recommendations Seller feels are important for the future health of dog. Seller assumes no liability for injury of dog during or after transport to Seller.

The following conditions apply to the sale of the aforementioned dog:

The Buyer must take the Dog to a licensed Veterinarian for a thorough exam within 3 days from the time of purchase. Proof of Veterinarian exam must be forwarded to the seller within 30 days. (E-mail as attachment to tom@mountaincreeklabradoodles.com) The health warranty will be voided if the Buyer does not have the puppy examined by a licensed Veterinarian within the initial three (3) day period and supply proof of examination within 30 days. Buyer has THREE (3) days from the time of receipt of dog to request returning dog for a full refund. Any request to return the dog to the Seller for a full refund must be made within this time period and may only be requested should the dog be examined by a veterinarian and found to have a health issue of such serious nature that the quality of life of the dog will be shortened or seriously altered. Minor health ailments including , but not limited to, fleas, worms, viral illness, Giardia, Coccidia, improper bites, hernias, hypoglycemia, or stress induced diarrhea due to the puppy’s transition from the Seller’s home are not reason for the dog to be returned to the Seller. Proof of examination and diagnosis of serious health issue must be provided to Seller should Buyer wish to request returning dog for a refund. Proof of pre‐existing ailment or condition that requires minor treatment and will not alter or shorten the dogs life will be reason for Seller to reimburse Buyer for the expenses associated with medications treating that ailment or condition. Some exclusions are; Fleas, Stress Induced Diarrhea, improper bites (unless severe), hernias.

Shipping fees for returning a dog are the Buyer’s responsibility.

A warranty for HD (hip dysplasia) is provided until two years of age. This warranty will be terminated should dog be allowed to become overweight or developing joints be overstressed, overused, or over exercised at any point during the warranty period. Veterinary medical records will be required showing the weight of dog and veterinarians assessment of the weight. Buyer agrees to provide Seller with all documents from date of purchase regarding the dogs compete health records from Buyers veterinarian(s), and must discuss treatment options with Seller before moving forward with treatment, failure to do so will void warranty. Should dog be found to have HD within its first two years, Buyer must provide Seller with proof in the form of documentation from PennHIP. We reserve the right to confirm the result before a replacement or refund is provided. Should medical records, correspondence or PennHIP indicate that an injury may have occurred or contributed to the issue, no reimbursement will be provided to Buyer from Seller. If above conditions are met, Seller will reimburse Buyer the veterinary costs up to half the purchase price of the dog.

A warranty against all serious life‐threatening or life‐altering inherited health issues is provided for dog until six months of age. Should such a condition occur during this time that will greatly shorten the life of or greatly alter the quality of life of dog, Seller will reimburse Buyer the veterinary costs up to half the purchase price of the dog, provided the following conditions have been met; Two independent veterinary examinations and reviews must be provided to Seller documenting the inherited health issue. Buyer must contact the Seller within 14 days upon first discovery of potential health issue. Buyer agrees to provide Seller with all documents from date of purchase regarding the dog’s compete health records from Buyers veterinarian(s), with 14 days upon first discovery of potential health issue. Buyer must discuss treatment options with Seller before moving forward with treatment, failure to do so will void warranty. Reports must state the treatments provided, and fees for the treatments. Seller will only reimburse for fees directly related to the inherited disease or condition. Seller will not be held responsible for the development of fault diseases or disorders which are the direct result of environmental factors or Buyers negligence. If puppy should die from a suspected inherited defect within six months of its date of birth, an autopsy must be performed at the purchaser’s expense by a veterinary hospital or state licensed DVM acceptable to the Seller’s own veterinarian. If the autopsy shows a inherited defect as the reason of the death, the Seller will provide another puppy of equal value to the purchaser. A written statement from the veterinarian must be provided. This warranty is void in the event of an indeterminable or inconclusive diagnosis.

Buyer has been provided with information regarding the potential risks of vaccinations. Health issues that are the result of vaccinations including: sarcomas, tumors, auto‐immune disorders, thyroid disease, allergies & seizures that occur following an administered vaccine will not be covered under the genetic portion of this warranty. Vaccine related allergy issues that result in itching issues can occur up to two months after administered vaccine. If itching issues develop Seller will not be held liable. Buyer agrees to not allow vet to administer any vaccine if the dog’s system is under duress from other physical health issues including but not limited to: parasites in the intestinal system, injury or illness. Buyer also agrees to not have the rabies vaccine administered at the same time as any other vaccine, but to allow at minimum three weeks from the last vaccine date before having rabies vaccine administered to dog.

Warranties shall apply only to original purchaser. Transfer of dog ownership shall void all such provisions of this agreement.

The Buyer agrees to provide a safe and loving home. If for any reason the Buyer cannot keep the dog, and cannot secure a suitable home, the seller will help the Buyer re-home the dog, seller has first right of refusal. Under no circumstances should the dog be placed in an animal shelter.

Under no circumstances shall the Seller be liable to the Buyer or to any third party for any consequential incidental or special damages resulting from or in manner related to the dog.

Upon execution of this contract all veterinary care and its associated costs are the sole and exclusive responsibility of the buyer.

Buyer agrees that their Labradoodle will be housed indoors.

Buyer agrees to feed their Labradoodle only a premium quality food and kept at a healthy weight, otherwise, warranty for hip dysplasia will be voided.

Buyer agrees to make and keep annual veterinary appointments for their Labradoodle and keep all immunizations current according to the guidelines of the AVMA as well as administer heartworm preventative.

Buyer agrees to provide basic obedience training with their Labradoodle puppy within the first four months of age.

Buyer agrees to postpone strenuous, repetitive exercise, climbing of stairs, entering into agility competitions, being a jogging/running partner, jumping from high heights, until after their Labradoodle is over one year of age, otherwise, warranty for hip dysplasia will be voided.

This dog has been sold as pet stock only, spay or neuter required by 6 months and proof forwarded to breeder by 6 months and 1 week old. Failure to comply voids the heath warranty.

NOTE: If Buyer does not Spay/Neuter puppy and provide proof of spay/neuter, the Buyer agrees to pay the seller;

$500.00 – Upon demand after 8 months, or $7000.00 - If used for breeding purposes (average cost of Australian Labradoodle Breeding Dog)

Buyer also agrees to relinquish all rights of dog and its offspring (if applicable) should the dog be bred in breach of this contract, and the seller has the right to reclaim the dog and its offspring (if applicable).

The Buyer understands that the Seller does not have control over the future temperament, habits, shedding, final weight and appearance of the Dog, and hence does not warrant such.


TEMPERAMENT & TRAINING

Buyer understands that all puppies exhibit certain undesirable behaviors (nipping, chewing, barking, marking, etc). Buyer is responsible for appropriate training of puppy to correctly teach acceptable behaviors, and it’s responsible for proper socialization of puppy. Buyer agrees to provide obedience training to puppy no later than 16 weeks of age and to continue with training as long as necessary to establish a solid foundation for a well socialized puppy. Training may be done independently or through professional trainers. Should Buyer not be successful at obedience training or training of negative behaviors independently, Buyer agrees to seek professional help from a certified trainer should it become necessary. Behaviors that develop due to lack of proper training and socialization are not the Seller’s responsibility.

FULL AND FINAL AGREEMENT

The parties agree that this writing represents the entire Agreement between them and that no other representations have been made regarding the dog described above. Any disputes, mediation or legal proceedings will take place in the state of South Carolina.
